ICE memo reportedly tells agents they can enter homes without judge-issued warrants
US federal immigration officers are being told they can legally force entry into someone’s home to make an arrest without a warrant signed by a judge, according to an Immigration and Customs Enforcement (ICE) memo obtained by The Associated Press.
The memo, signed by ICE’s acting director, states that administrative warrants are sufficient for forced entry if there’s a final order of removal.
California-based lawyer Neama Rahmani said the memo goes against the Fourth Amendment to the US constitution, which requires a judge-issued warrant to enter someone’s home.
